01Acceptance of the Terms
By accessing the Service, creating an account, generating an API key, issuing an API request, connecting an MCP client, clicking “I agree,” or otherwise using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference.
If you are using the Service on behalf of a company, organization, or any other legal entity, you represent and warrant that (a) you have the authority to bind that entity to these Terms, and (b) in that case, “you” and “your” refer to that entity. If you do not have such authority, or if you disagree with any part of these Terms, you must not access or use the Service.
These Terms form a legally binding agreement between you and Trends MCP.
02Definitions
- “Account” means your registered user profile, including any associated API keys, billing information, and usage records.
- “API” means the REST interface offered by Trends MCP at endpoints documented on trendsmcp.ai/docs.
- “MCP” means the Model Context Protocol, an open standard maintained by third parties through which AI assistants can connect to external servers.
- “MCP Server” means the Trends MCP-operated server implementation that exposes the Service over the Model Context Protocol.
- “Third-Party Data Sources” means the external platforms from which Trends MCP derives its signals, including but not limited to Google, YouTube, TikTok, Reddit, X (Twitter), Wikipedia, Amazon, Google Play, Apple’s App Store, Spotify, Steam, and npm.
- “Output” means any data, response, score, time series, ranking, feed, or other information returned by the Service.
- “User Content” means any data, queries, prompts, parameters, or other content you submit to the Service.
03Eligibility and Accounts
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) and legally capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and are not barred from using the Service under the laws of your jurisdiction.
You are responsible for:
- providing accurate, current, and complete information when registering;
- maintaining the security of your credentials and API keys;
- all activity that occurs under your Account, whether or not you authorized it; and
- notifying us immediately at [email protected] of any suspected unauthorized use.
We may suspend, terminate, or refuse to create any Account at our sole discretion.
04Description of the Service
Trends MCP provides normalized, aggregated, and derived signals of behavioural, search, social, commerce, entertainment, and developer activity sourced from publicly accessible Third-Party Data Sources. The Service exposes these signals through a REST API and an MCP Server, and may include related tooling, documentation, dashboards, and support materials.
The Service is an analytics product. It is not a financial instrument, exchange, brokerage, advisory service, legal counsel, medical device, or any other regulated service. We make no representation that any Output is complete, accurate, current, suitable for any particular purpose, or fit for use in any regulated context.
05Free Tier, Paid Plans and Billing
Free tier
We may, at our discretion, offer a free tier (currently 100 API requests per calendar month). The free tier is provided on an “as-is” basis and may be modified, limited, rate-capped, metered, or withdrawn at any time without notice.
Paid plans
Paid plans are billed in advance on a recurring basis at the rates disclosed on our pricing page at the time of purchase. You authorize us, and our payment processors, to charge your payment method for all fees incurred.
Taxes
All fees are exclusive of VAT, GST, sales tax, use tax, and any other taxes, duties, or government charges, all of which are your responsibility.
Auto-renewal
Unless you cancel before the end of the current billing cycle, your subscription will automatically renew at the then-current rate. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period.
No refunds
Except where expressly required by applicable mandatory law (see Section 24 — Consumer Rights), all fees are non-refundable, and no refunds or credits are provided for partially used periods, downgrades, unused requests, service suspensions due to your breach, or Service interruptions.
Price changes
We may change our prices at any time. Price changes for existing subscriptions take effect at the start of the next billing cycle after we provide notice (which may be by email or in-app). Continued use after a price change constitutes acceptance.
Chargebacks
If you initiate a chargeback or payment dispute in bad faith or contrary to these Terms, we may suspend or terminate your Account and recover the disputed amount plus any associated fees.
06API Keys, Rate Limits and Fair Use
API keys are personal to your Account and must not be shared, resold, embedded in publicly accessible client-side code, or distributed to any third party. You are solely responsible for all requests made using your keys, regardless of who makes them.
We enforce rate limits, request caps, per-endpoint quotas, concurrency limits, and other technical controls. You agree not to circumvent, disable, or attempt to bypass these controls, including by creating multiple accounts to exceed free-tier limits.
We may throttle, suspend, or terminate access immediately and without notice if we determine, in our sole discretion, that your usage is abusive, fraudulent, disruptive, or inconsistent with the spirit of a fair-use API product.
07Acceptable Use and Prohibited Conduct
You agree that you will not, and will not permit any third party to:
- violate any applicable law, regulation, court order, or third-party right, or use the Service in any jurisdiction where it is prohibited;
- reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying ideas, algorithms, structure, or organization of the Service, except to the extent this restriction is prohibited by applicable law;
- scrape, harvest, or otherwise extract data from the Service through automated means other than the API within its documented quotas;
- use Output to build, train, fine-tune, or improve any machine-learning model, large language model, search index, or competing trend or analytics product without our prior written consent;
- resell, sublicense, lease, white-label, republish, or redistribute the Output or the Service, in whole or in substantial part, as a standalone product;
- remove, alter, or obscure any copyright, trademark, or proprietary notice contained in the Service or Output;
- use the Service to transmit malware, spyware, viruses, or any harmful code, or to interfere with or disrupt the integrity or performance of the Service or the data contained therein;
- use the Service to harass, stalk, defame, dox, or harm any individual, or to generate content that is unlawful, defamatory, infringing, discriminatory, harassing, or sexually exploitative (especially involving minors);
- use the Service to make fully automated, consequential decisions about individuals (such as credit, employment, housing, insurance, or law-enforcement decisions);
- attempt to probe, scan, or test the vulnerability of the Service or any related system (other than through a formally disclosed security-research program);
- impersonate any person or entity, misrepresent your affiliation, or provide false information;
- use the Service for high-risk applications where failure or inaccuracy could reasonably be expected to lead to death, personal injury, or severe environmental damage;
- use the Service in a manner that violates the terms of service or acceptable-use policies of any Third-Party Data Source.
Violation of this section is a material breach and authorizes us to suspend or terminate your Account immediately and without refund.
08Third-Party Platforms and Data Sources
Trends MCP derives signals from Third-Party Data Sources that we do not own, operate, endorse, or control. Those sources may change, rate-limit, restrict, or remove access to their data at any time. When that happens, the corresponding portion of the Service may be degraded, delayed, inaccurate, incomplete, temporarily unavailable, or permanently withdrawn. We accept no liability for any such change.
You acknowledge and agree that:
- Output is a normalized, aggregated, and/or derived interpretation of third-party signals. It is not a verbatim copy of any source’s underlying data.
- Names, trademarks, service marks, logos, and platform identifiers of Third-Party Data Sources are the property of their respective owners and are used nominatively solely to identify the sources of signals.
- You are solely responsible for complying with any terms, licenses, or policies that apply when you use Output in a way that interacts with a Third-Party Data Source (for example, when you display results next to branded content).
- We may remove, rename, re-bucket, rescale, or otherwise modify any Third-Party Data Source, metric, score, or field at any time, including in a manner that is not backwards-compatible.
09No Professional Advice
The Service and all Output are provided for informational and analytical purposes only. Nothing in the Service constitutes investment, financial, tax, accounting, legal, medical, safety, engineering, or other professional advice. Output is not a recommendation to buy, sell, or hold any security, digital asset, or other instrument, and is not a solicitation or offer to transact in any instrument in any jurisdiction. You must consult a qualified professional before making any decision that has financial, legal, medical, or other material consequences.
You assume full responsibility for any decision made, action taken, or product built in reliance on the Service or Output. Trends MCP has no fiduciary duty to you.
10AI Assistants, LLMs and MCP Clients
When you connect the Service to an AI assistant, large language model, agent, or MCP client (including but not limited to Claude, ChatGPT, Cursor, Continue, Windsurf, VS Code, or any other third-party tool), you acknowledge that:
- those clients are third-party products governed by their own terms, privacy policies, and usage policies, for which we are not responsible;
- AI models may misinterpret, hallucinate, summarize, or transform Output in ways that materially change its meaning;
- you are responsible for reviewing any AI-generated interpretation of Output before acting on it; and
- we do not guarantee compatibility with any specific AI model, protocol version, or client implementation.
Use of AI with the Service is at your sole risk. We expressly disclaim any liability for inaccurate, misleading, or harmful AI-generated content produced from Output.
11Intellectual Property
Our IP
The Service, including all software, documentation, designs, user interfaces, trademarks, logos, content, and the selection, arrangement, and compilation of Output, is owned by Trends MCP or its licensors and is protected by copyright, trademark, and other intellectual-property laws. All rights not expressly granted to you are reserved.
License to you
Subject to these Terms and your timely payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service and to internally use Output solely for your own lawful business or personal purposes. This licence terminates automatically upon any breach of these Terms or upon termination of your Account.
Attribution
Where you display Output externally, we ask (but do not require, except where otherwise stated) that you attribute it as “Data via Trends MCP” with a link to trendsmcp.ai.
12Your Content and Feedback
You retain ownership of User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, process, transmit, display, and otherwise use User Content solely to operate, maintain, and improve the Service, to enforce these Terms, and to comply with legal obligations.
If you provide any ideas, suggestions, feature requests, bug reports, or other feedback (“Feedback”), you grant Trends MCP a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable, transferable licence to use, modify, and commercialize the Feedback for any purpose, without compensation or attribution to you.
You represent and warrant that your User Content does not infringe any third-party right and does not violate any law.
13Privacy
Our collection, use, and disclosure of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
14Confidentiality
Non-public information that we make available to you about the Service (including API design, roadmap, pricing not on our public pricing page, security measures, and benchmark results) is our Confidential Information. You must protect it using at least the same care you use to protect your own confidential information of similar importance (and in no event less than reasonable care), and must not disclose it or use it other than to exercise rights or perform obligations under these Terms.
15Changes to the Service
We are continuously improving the Service. We may add, modify, deprecate, or remove features, endpoints, sources, fields, score definitions, or functionality at any time, with or without notice. We will use commercially reasonable efforts to provide advance notice of materially breaking API changes to the extent practicable, but we make no guarantee of any specific deprecation window or backwards-compatibility window.
16Warranty Disclaimers
The service, api, mcp server, documentation, and all output are provided “as is” and “as available,” with all faults and without warranty of any kind. to the maximum extent permitted by law, trends mcp, its affiliates, officers, directors, employees, agents, licensors, contractors, suppliers, and data providers disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, timeliness, completeness, availability, reliability, compatibility, or that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
we do not warrant that any output is accurate, current, complete, reliable, or suitable for any purpose. any reliance you place on the output is strictly at your own risk. no advice or information, whether oral or written, obtained from trends mcp or through the service, shall create any warranty not expressly stated in these terms.
Some jurisdictions do not allow the exclusion of certain warranties. To the extent any disclaimer in this section is unenforceable under mandatory applicable law, the disclaimer shall be limited to the minimum extent necessary, and the remaining disclaimers shall remain in full force and effect.
17Limitation of Liability
to the maximum extent permitted by law, in no event shall trends mcp, its affiliates, officers, directors, employees, agents, licensors, contractors, suppliers, or data providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; any loss of profits, revenue, business, goodwill, anticipated savings, or opportunity; any trading, investment, or portfolio losses; any loss or corruption of data; any loss arising from the accuracy or inaccuracy of output; any loss arising from the unavailability of a third-party data source; or any substitute-goods cost, arising out of or in connection with these terms or your use of (or inability to use) the service, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not trends mcp has been advised of the possibility of such damages.
to the maximum extent permitted by law, trends mcp’s total aggregate liability arising out of or relating to these terms or the service, regardless of the form of action, is limited to the greater of (a) the fees actually paid by you to trends mcp for the service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred us dollars (usd 100). for free-tier users, liability is limited to usd 100.
The limitations in this section apply to the fullest extent permitted by law, even if any remedy fails of its essential purpose, and are fundamental elements of the bargain between you and Trends MCP. Some jurisdictions do not allow certain limitations of liability, in which case Trends MCP’s liability will be limited to the smallest extent permitted by applicable law.
18Indemnification
You agree to defend, indemnify, and hold harmless Trends MCP and its affiliates, officers, directors, employees, agents, licensors, contractors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- your access to or use of the Service;
- your User Content or the Output you produce from it;
- your violation of these Terms, any applicable law, or any third-party right (including any terms of a Third-Party Data Source);
- your fraud, willful misconduct, or gross negligence; and
- any product, service, dataset, report, model, or decision you build on or derive from the Service.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
19Term and Termination
These Terms remain in effect while you use the Service. You may terminate at any time by closing your Account. We may suspend or terminate your Account, access, and any API keys at any time, with or without cause, with or without notice, and without liability.
Upon termination, your right to access the Service ends immediately. Sections that by their nature are intended to survive termination (including Sections 7–9, 11, 12, 16–18, 22–23, and 26) will survive.
20Export Controls and Sanctions
The Service may be subject to export-control, sanctions, and import laws and regulations of the European Union, the United States, the United Kingdom, and other jurisdictions. You represent and warrant that:
- you are not located in, ordinarily resident in, or a national of any country subject to comprehensive sanctions (including, at the time of drafting, Cuba, Iran, North Korea, Syria, the Crimea region, and the so-called Donetsk and Luhansk regions of Ukraine);
- you are not identified on any restricted-party or sanctions list maintained by the EU, the US Department of the Treasury’s Office of Foreign Assets Control (OFAC), the US Department of Commerce, the UK, or the United Nations; and
- you will not use the Service in violation of any export or sanctions law.
21Force Majeure
Neither party is liable for any failure or delay in performance (other than payment obligations) caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, riots, labour disputes, government actions, pandemics, internet or utility outages, denial-of-service attacks, failures of Third-Party Data Sources, or failures of upstream infrastructure providers.
22Governing Law
These Terms and any dispute arising out of or in connection with them are governed by the laws of the State of Delaware, United States, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. Where you are a consumer resident in the European Economic Area, the United Kingdom, or any other jurisdiction with mandatory consumer-protection laws, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of habitual residence.
23Disputes and Arbitration
Before filing any formal proceeding, the parties agree to attempt to resolve any dispute in good faith through written notice to [email protected] and a 30-day informal negotiation period.
If the dispute is not resolved, and subject to any mandatory consumer-protection law that grants you a different forum, any dispute, controversy, or claim arising out of or relating to these Terms or the Service will be submitted to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, United States.
Class-action waiver. To the maximum extent permitted by law, you agree that any dispute will be brought on an individual basis only, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You and Trends MCP waive any right to a jury trial.
24Consumer Rights
If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction whose mandatory consumer law applies to you, nothing in these Terms limits the rights granted to you by that law, including any statutory right of withdrawal. Consumers in the EU can access the European Commission’s online dispute-resolution platform at https://ec.europa.eu/consumers/odr. We are not, however, obliged to participate in alternative dispute resolution before a consumer arbitration board.
25Changes to These Terms
We may modify these Terms at any time. When we do, we will update the “Last updated” date at the top of this page and, for material changes, take reasonable steps to notify you (for example, by email, in-app banner, or changelog). Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of them. If you do not agree to the changes, you must stop using the Service.
26Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any order form or plan terms to which you have agreed, constitute the entire agreement between the parties with respect to the Service and supersede all prior or contemporaneous agreements and communications.
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be reformed to the minimum extent necessary to make it enforceable.
- No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms or any of your rights or obligations hereunder, by operation of law or otherwise, without our prior written consent, and any attempted assignment in violation of this section is void. We may freely assign these Terms, including in connection with any merger, acquisition, reorganization, or sale of assets.
- Relationship of the parties. The parties are independent contractors. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship.
- No third-party beneficiaries. Except as expressly provided, these Terms do not create any third-party-beneficiary rights.
- Notices. We may provide notices by posting on the Service, by email to the address associated with your Account, or by any other reasonable means. You must send notices to us in writing to the contact email below.
- Language. These Terms are concluded in English. Any translation is provided for convenience only; in case of conflict, the English version prevails.
- Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
